Deferred Enforced Departure (DED) for Haitian Nationals

Enclosed for your information and use are the following items related to Deferred Enforced Departure (DED) for Haitian nationals:

  • INS Office of Programs memorandum of March 12, 1998 on Deferred Enforced Departure (DED) and Related Benefits for Certain Haitian Nationals. The memorandum identifies Haitian nationals eligible for DED and employment authorization until December 22, 1998. Among other matters covered are bars to eligibility, advance parole and INS procedures related to encountered aliens.
  • Attached to the memorandum is Form 1-765D, Haitian DED Supplement, to be used with Form 1-765 to apply for an Employment Authorization Document (EAD). The 1-765D supplement form may be photocopied, either one-sided and stapled or twosideded in a head-to-foot format. Provider organizations assisting Haitians to file for DED work authorization are encouraged to bundle the 1-765 applications with the supplement forms (preferably in batches of 25) and enclose them in envelopes clearly marked "Haitian DED." The application packet must be filed with the appropriate INS service center, according to instructions on the 1-765. No fee is required with the application.
  • An INS news release of March 12, 1998 on Deferred Enforced Departure for Haitians, which includes a series of questions and answers related to DED issues.
